FAQs – End User Terms of Use Update – October 22, 2022

On October 26, 2022, WinRed Technical Services LLC is updating our End User Terms of Use and related terms which apply to the use our services. More information on these changes, including a summary of the most notable changes and when they take effect, is outlined below.

When will these changes take effect?

The updated End User Terms of Use and related terms will take effect on October 26, 2022. If you do not agree to the updated terms, you will need to stop using our services. Your use of our products and services after the effective date will be subject to these updated terms.

Do I need to take action?

If you are okay with the updated terms, you don’t need to take any action.

What is changing?

Some of the most notable changes include:

• Terms Cover Additional Services

We have expanded the types of services that can be offered through WinRed, by WinRed Technical Services, LLC or its affiliates or services providers, and expect to continue to expand these services. Some examples include fundraising processing services for state and local candidates, fundraising processing services for non-profit organizations, conducting surveys, provision of products, contests and sweepstakes, or other promotions, and other functions. Additional services may be subject to separate agreements or terms with the provider(s) of those services. The Terms of Use have been updated to refer to these services, and to provide that if separate terms are provided for these additional services, those separate terms will govern and control with respect to those services.

• More Description of Process for Amendment and Accounts

As our products and services evolve and the world around us changes, we’ll need to update our terms from time to time. We may do so by posting a revised version of the terms, and have clarified the terms for notice and opt-out if we make changes to these terms.

You may have created or may create an account under terms and conditions in addition to or separate from the WinRed End User Terms of Use. Your account will continue to be governed by such other terms, in addition to the End User Terms of Use that apply to your use of the WinRed platform.

• Indemnified Parties

We operate the platform in collaboration between WinRed Technical Services, WinRed Inc. and their parents, subsidiaries, officers, employees, and website contractors and each of their officers, employees and agents. We have clarified our terms to make consistent our use of the term “Indemnified Parties” to refer to all of these entities and individuals, and to protect such persons from liability for the transactions conducted on our platform, and other matters.
